What Will Happen To My Assets?

Dividing property and assets is rarely easy. If you and your partner cannot reach an agreement privately, the court will decide for you. Indiana is an equitable distribution state, meaning that the court divides marital property fairly between spouses.

Fairly does not necessarily mean a 50-50 split. A number of factors will be evaluated during this process. It is important to partner with an experienced lawyer who can advocate for a favorable division promoting your long-term financial security. If you own a small business, property division can be particularly difficult. We will strongly advocate for your business to prevent dissolution during the divorce.

How Will We Share Parenting Time?

Indiana often requires divorcing parents to take a parenting class before issuing a custody decision. Hammerschmidt, Amaral & Jonas knows what factors the court evaluates to determine custody. We will work towards an arrangement that is in you and your children’s best interests.

In most arrangements, ex-spouses share custody of the children. The court prefers for both parents to be involved in the children’s lives; however, there are exceptions to this rule.
